Online Gambling Sites Win One More Round

Kentucky, a haven for gamblers who want to bet on horse racing, has hit a setback in its efforts to stop unregulated online casino gambling. In a 2-1 ruling Tuesday, the Kentucky Court of Appeals said the state does not have the jurisdiction to seize 141 online casinos’ Internet domain names in an effort to keep them from operating in the state. The ruling also said a Franklin Circuit Court judge cannot hold further hearings on the issue. “This is a tremendous victory for Internet freedom and the rights of Kentucky residents who enjoy playing online poker,” said John Pappas, executive director of the Poker Players Alliance, in a statement. It has been estimated that about 13,000 Kentuckians play the online casinos. Jay Blanton, a spokesman for Gov. Steve Beshear, said the state did not receive the ruling until late Tuesday. “We want to take some time to review it. No decision has yet been made on whether to appeal it to the state Supreme Court,” Blanton said. (more…)

Online Gambling Legalization in The US Can Really Happen

dps Barney Frank – the chairman of the US Financial Services Committee – has introduced a bill that would legalize and regulate online gambling in the country. The bill is called the Internet Gambling Regulation, Consumer Protection, and Enforcement Act of 2009 (IGRCPEA). Though this new law can be considered similar to Frank’s previous bill called Internet Gambling Regulation and Enforcement Act of 2007, it is a more through carefully worked out law, where the main emphasis is laid on customer protection. This emphasis can convince oppositionist of online gambling legalization of the necessity of adopting the bill. The viewpoint of the previous law opponents was based on the children and problem gamblers concern. But the additions to the newly created bill carefully stipulate those controversial aspects.

Isle of Man – the New Rules of e-Gaming Excellence

Antigua and Barbuda and the USA gambling licenses problems disputes history

In June of 2003 Antigua and Barbuda initiated the dispute process of the World Trade Organization against the U.S. Antigua argued that the U.S.’s restrictive Internet gambling policies constitute a violation of an international pact called the General Agreement on Trade in Services (GATS). The compliance deadline of April 3, 2006 passed without any U.S. action. In fact, U.S. legislators actually worked to pass contrary legislation and were eventually successful in passing a bill aimed at prohibiting online gambling altogether in September of 2006.

In November of 2004 a WTO dispute panel ruled that the U.S. does indeed give preferential treatment to its domestic remote gambling operators in violation of the GATS. Following an appeal by the U.S., the Appellate Body of the WTO issued a similar ruling in April of 2005. The U.S. was then given a one-year period in which to bring its laws into conformity with the GATS, which it could do either by giving Antiguan operators access to the U.S. market or by shutting down its domestic remote horse race wagering operators. How To Get Alderney Gambling License

The following Alderney gambling licenses are available:
Full eGambling licences
Associate Certificates;
Hosting Certificates; and
Restricted Use eGambling licences.

LICENCE APPLICATION AND LAUNCHING PROCESSES

PHASE 1: LICENCE APPLICATION

Step 1: Form an Alderney Registered Company and cause a Notice of Application for a Full eGambling licence to be published in the Alderney Gazette, as provided for in Regulation 3 and in the form set out in Part II of Schedule 1 of the Alderney eGambling Regulations,2006.

Step 2: The Alderney Registered Company submits the application to the Licensing Officer, consisting of the following:
A signed copy of the Application Form provided for in Schedule 1 Part 1 of the eGambling Regulations;
Payment to the AGCC of the initial deposit of investigation moneys of £10,000, as provided for in Regulation 2. Account details are available from the Licensing Officer; and A copy of the Notice of Application, published in the Alderney Official Gazette, as provided for in Regulation 3, should be provided to the Licensing Officer for display on the Commissions’ website as provided for in Regulation 4. Obama administration gives hope for Online Casino Industry

Nobody is sure what is or what will happen with online gambling situation in United States. A lot of people have no clue how the whole circumstance is developing. However, some companies are surreptitiously seeking to go back into American market throughout the Obama administration.

A lot of online companies gave up the U.S. market following the Unlawful Internet Gambling Enforcement Act being issued by Republicans in Congress in 2006. At the present, some of those companies are following carefully what is taking place in America.

Lately the US Treasury issued the regulations for UIGEA – whilst this was unpleasant news as it indicates the act was at last being imposed, it did not change much apart from making financial institutions adjust their contract letters to clients. Obama, the present President-elect who is going to be inaugurated in January 2009, is not going to make online gambling a main concern but his democrat administration is going to be much more moderate.

Taiwan Set To Approve Casinos

Under the plan, three casinos would be built in Penghu, an island chain in the Taiwan Strait.
Taiwan’s parliament is set to legalize gambling on offshore islands as soon as the end of 2008, news agencies have reported.

In a private meeting on Friday, Taiwanese lawmakers agreed to put the bill to a formal vote, with a majority indicating their support, a senior legislative aide said.

The passing of the bill would allow casinos to be built in the Penghu archipelago (also known as the Pescadores) situated between Taiwan and mainland China, southeast of the Taiwan Strait. (more…)

Treasury and Fed finalize UIGEA regs

Big news for poker players out of Washington today – the Fed and Treasury announced that they’re done with the regulations they were assigned to write for the UIGEA two Octobers ago.

There are a couple of important points for poker players to note. First, nothing about the regulations appears to apply to cashouts – only deposits. Second, banks have until December 1st, 2009 to comply with the regulations. (more…)
